01. What this can do

Among adults who agree, this page disclaims warranties, limits damages, puts your content on you, asks you to cover your own misconduct, and states the ordinary civil limits of operator and staff liability for member-to-member interactions.

02. What this cannot do

• Excuse crimes, including child sexual exploitation, CSAM, grooming, or trafficking.
• Stop Discord from removing a server or banning operators.
• Waive liability the law says cannot be waived, including fraud, willful misconduct, gross negligence, or personal injury where those limits are banned.
• Bind a minor. People under 18 generally cannot give a clean contractual waiver, which is one reason 18+ spaces stay 18+.
• Protect staff who knew a minor was in an 18+ room and left them there, or who ignored illegal content they had actually seen.

03. No verification. No professional service

We do not verify identity or age beyond what people report and what staff actually see. We are not liable for member content except where staff have actual knowledge of illegal content and fail to act as Discord's rules or the law require.

04. Warranties

Community spaces and this site are provided as is and as available, without warranties of any kind, including merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement. We do not promise uninterrupted, secure, or error-free access, or that content is accurate.

05. Limitation of liability

To the maximum extent permitted by law, operators, staff, and anyone acting for them are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, from your use of the community.

To the maximum extent permitted by law, total liability for any claim shall not exceed one hundred U.S. dollars (US $100), or the amount you paid us in the twelve months before the claim, which is typically zero.

Where a jurisdiction does not allow a limit, liability is limited to the greatest extent still allowed. Nothing here limits liability the law says cannot be limited.

06. Release

You release operators and staff from claims arising out of member-to-member interactions, user-generated content, and your voluntary participation, except claims that cannot be released under applicable law.

07. Indemnity

You will indemnify and hold harmless operators and staff from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your conduct, a misrepresented age or identity, or a violation of these rules or Discord's Terms of Service.

08. Harm between members

Subject to the limits above, Melo and its staff are not responsible for harm, loss, or damages from interactions between members, or from content you or other members choose to share.
